Terms of Service

Welcome to Lumiento ("Lumiento", "we", "us", or "our"), a wedding and event management platform operated by ADasy GROUP. These Terms of Service (the "Terms") form a legally binding agreement between you ("you", the "user") and Lumiento. Please read them carefully. By creating an account or using the Service you confirm that you have read, understood, and accepted these Terms and our Privacy Policy.

1. The Service

Lumiento provides an online platform that allows engaged couples and event organisers to create event landing pages, collect RSVPs, manage guest lists, send communications to invited guests, receive uploaded photographs and wishes, display optional gift information including IBAN, and export event media (the "Service"). The Service is currently provided free of charge but Lumiento reserves the right to introduce paid plans, subscriptions, or fees for specific features in the future, subject to Section 11.

2. Eligibility

  • You must be at least 18 years old and have full legal capacity to enter into binding contracts.
  • You must provide accurate, current and complete information during registration and keep it updated.
  • You are responsible for maintaining the confidentiality of your password and for all activity that occurs under your account.
  • One account per person. Accounts may not be shared, sold, or transferred.

3. Your Content and Licence to Lumiento

You retain all ownership and intellectual-property rights in the content you submit to the Service (photos, text, guest lists, wishes, event details — "Your Content"). By submitting Your Content you grant Lumiento a non-exclusive, worldwide, royalty-free, sublicensable licence to host, store, reproduce, transcode, resize, thumbnail, back up, transmit, and display Your Content solely for the purpose of operating and providing the Service to you. This licence terminates when you delete the content or the account, except for backups retained for a reasonable period for security and legal-compliance purposes. We will not use Your Content for advertising, marketing of third parties, training of machine-learning models, or any purpose unrelated to providing the Service.

4. Acceptable Use — Prohibited Conduct

You agree that you will not, and will not permit any third party to:

  • Upload, post, or transmit any content that is unlawful, infringing, defamatory, obscene, pornographic, hateful, harassing, threatening, that depicts minors in a sexual manner, or that violates the privacy or publicity rights of any person;
  • Upload photographs of identifiable persons without having obtained the necessary consents;
  • Use the email and notification features to send spam, unsolicited commercial messages, political campaigning, charitable solicitations, chain letters, or any messaging unrelated to the legitimate event. The guest-email feature is provided strictly to communicate event logistics with invited guests who have a reasonable expectation of receiving such communications;
  • Impersonate any person, create fake events, or misrepresent your affiliation with a person or entity;
  • Use the IBAN / gift-information fields fraudulently or to facilitate any illegal financial activity. You acknowledge that Lumiento is not a payment institution, does not process payments, does not hold funds, and assumes no responsibility for any transfer of money between guests and event organisers;
  • Attempt to gain unauthorised access to any part of the Service, other users' accounts, or the underlying systems, including by scraping, crawling, brute-force, credential-stuffing, or use of automated tools beyond the documented interfaces;
  • Reverse-engineer, decompile, or disassemble any part of the Service except to the extent expressly permitted by mandatory law;
  • Resell, sublicense, lease, rent, or otherwise commercialise the Service or access to it;
  • Introduce viruses, malware, or any code intended to damage or disrupt the Service;
  • Violate any applicable law or regulation, including data-protection, consumer-protection, anti-spam, and intellectual-property laws.

5. Notice and Takedown

If you believe content on the Service infringes your rights or violates these Terms, please email [email protected] with: (a) your identification and contact information; (b) a description and URL of the offending content; (c) the basis of your complaint; and (d) a good-faith statement that the complaint is accurate. We will review valid notices within a reasonable timeframe and may remove content, suspend, or terminate accounts at our discretion.

6. Guests, Couples and Data Controllership

When you create an event and upload a guest list, you act as the data controller for the personal data of your guests, and Lumiento acts as your data processor in respect of that data. You are solely responsible for ensuring that you have a lawful basis to add guest details and to send them communications via the Service. Lumiento provides standard processing terms within the Privacy Policy and will assist with data-subject requests where reasonably practicable.

6a. Communications from Lumiento

By creating an account you agree to receive transactional and service-related emails that are necessary to provide the Service — for example email verification, password resets, security alerts, event notifications you have configured, export-ready notifications, important changes to these Terms or the Privacy Policy, and replies to your support requests. These messages are sent on the basis of contract performance and cannot be opted out of while you maintain an active account.

Promotional and marketing emails (product news, newsletters, feature announcements, occasional offers) are sent only if you have explicitly opted in by ticking the optional checkbox during registration or in your account settings. You may withdraw this consent at any time by clicking the unsubscribe link in any marketing email or by emailing [email protected]. Withdrawal does not affect transactional emails and does not affect the lawfulness of marketing emails sent before withdrawal.

7. Service "AS IS" — No Warranties

The Service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express, implied, statutory or otherwise, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, uninterrupted availability, security, or non-infringement, to the maximum extent permitted by applicable law. We do not warrant that the Service will be uninterrupted, error-free, timely, or that any defect will be corrected. No guarantee is made as to availability on or around the date of your event.

8. No Liability for Data Loss or Infrastructure Failure

To the maximum extent permitted by applicable law, Lumiento is not liable for any loss, corruption, deletion, alteration, inaccessibility, or temporary or permanent unavailability of Your Content — including but not limited to photographs, videos, guest lists, RSVP responses, wishes, exported archives, scheduled emails, or event configuration — caused by:

  • failure, outage, or degradation of the hosting infrastructure (including our hosting provider Hetzner Online GmbH);
  • failure, outage, or degradation of our storage provider (including Cloudflare R2);
  • failure or delay in email delivery by our transactional email provider (including Resend);
  • database corruption, hardware failure, software bug, or human error;
  • any third-party service interruption, network outage, DNS failure, or denial-of-service attack;
  • any event of force majeure (war, natural disaster, pandemic, governmental action, internet failure, etc.).

You are strongly advised to keep your own independent copies of all photographs and important data. Lumiento makes commercially reasonable efforts to back up data but provides no backup guarantee, no recovery-point or recovery-time commitment, and no data-recovery service-level agreement. There is no uptime guarantee. The Service may be modified, suspended, or discontinued in whole or in part at any time. Nothing in this clause limits liability for gross negligence, wilful misconduct, death, or personal injury where such limitation is prohibited by applicable law.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • Lumiento, its affiliates, officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profit, loss of revenue, loss of goodwill, loss of opportunity, emotional distress, or loss of data, whether arising in contract, tort, statute or otherwise, even if advised of the possibility of such damages;
  • The total aggregate liability of Lumiento to you for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) the total fees you have paid to Lumiento in the twelve (12) months preceding the event giving rise to the claim or (b) one hundred euros (€100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for gross negligence, wilful misconduct, death or personal injury, or any non-waivable consumer-protection rights under European Union or national law.

10. Indemnification

You agree to indemnify, defend, and hold harmless Lumiento and its affiliates, officers, employees, and agents from and against any claims, damages, liabilities, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with: (a) Your Content; (b) your use of the Service; (c) your breach of these Terms; (d) your violation of any applicable law or any rights of a third party (including your guests); or (e) your misuse of the guest-email or notification features.

11. Paid Plans (Future)

Where the Service or specific features are offered for a fee in the future:

  • applicable prices, billing cycles, and payment terms will be displayed at the point of purchase and will form part of these Terms;
  • fees are payable in advance and are non-refundable except where required by mandatory law;
  • subscriptions may auto-renew; you may cancel future renewals at any time from your account settings;
  • EU consumers have a 14-day right of withdrawal under Directive 2011/83/EU; by requesting immediate access to digital content and the Service you expressly consent to immediate performance and acknowledge that the right of withdrawal is lost once the Service is provided;
  • Lumiento may change fees with at least 30 days' notice for ongoing subscriptions.

12. Term and Termination

These Terms remain in effect while you have an account. You may delete your account at any time from your account settings or by contacting [email protected]. Lumiento may suspend or terminate your account, with or without notice, if (a) you breach these Terms, (b) we are required to do so by law, (c) we reasonably suspect fraudulent, abusive, or illegal activity, or (d) we discontinue the Service. Upon termination, Sections 3 (residual licence for backups), 7–10, 13, and 14 survive.

13. Changes to the Terms

We may amend these Terms from time to time. Material changes will be notified by email and/or by an in-app notice at least 30 days before they take effect, except where a shorter period is required by law. Continued use of the Service after the changes take effect constitutes acceptance. If you do not agree with the changes, you must stop using the Service and may delete your account.

15. Miscellaneous

  • Entire agreement. These Terms together with the Privacy Policy constitute the entire agreement between you and Lumiento regarding the Service.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
  • No waiver. Failure to enforce any provision does not constitute a waiver.
  • Assignment. You may not assign these Terms; Lumiento may assign them in connection with a merger, acquisition, or sale of assets.
  • Notices. We may give notices by email, in-app message, or by posting on the Service. You may contact us at [email protected].
